Article 1 (Purpose)
These Terms of Service set forth the rights, obligations, and responsibilities between desub (hereinafter 'the Company') and its members regarding the use of the design subscription service (hereinafter 'the Service').
Article 2 (Definitions)
① 'Service' refers to the monthly design subscription service provided by the Company, where members pay a monthly fee and request/receive design work. ② 'Member' refers to a person who has agreed to these Terms and entered into a service agreement with the Company. ③ 'Subscription' refers to a member paying a fixed monthly amount and using the Service. ④ 'Pause' refers to a member temporarily suspending their use of the Service during the subscription period.
Article 3 (Effectiveness and Modification of Terms)
① These Terms take effect when posted on the Service screen or otherwise communicated to members. ② The Company may revise these Terms within the scope of applicable laws, and will announce revisions at least 7 days before their effective date. ③ Members who do not agree to the revised Terms may discontinue use of the Service and withdraw their membership.
Article 4 (Service Content)
① The Company provides the following services: • Graphic design / UI·UX design work • Up to 1 design request per day • Delivery within 48 hours (sequential extension based on scope) • Unlimited revisions • Subscription pause and cancellation features ② Specific details, usage methods, and hours of the Service follow the guidance provided within the Service.
Article 5 (Service Agreement)
① A service agreement is concluded when an applicant agrees to these Terms, applies for membership, and the Company approves the application. ② The Company may reject an application in the following cases: • Using a false identity or another person's information • Providing false information • Failing to meet other requirements set by the Company
Article 6 (Subscription and Payment)
① The subscription fee is ₩1,750,000/month (VAT included) and is charged automatically each month. ② A 1-week free trial is provided upon initial registration. ③ Payments are processed through Toss Payments and automatically charged to the registered payment method. ④ Subscription fees may be changed with at least 30 days' prior notice through the Service.
Article 7 (Subscription Pause)
① Members may pause their subscription during the subscription period. ② During the pause period, no subscription fee is charged and design requests cannot be made. ③ Pausing can be requested through the in-service settings.
Article 8 (Cancellation and Refund)
① Members may cancel their subscription at any time. Upon cancellation, the Service remains available until the end of the current billing cycle. ② No charges apply if cancelled during the free trial period. ③ After the paid subscription begins, refunds follow these guidelines: • No design requests made in the current month: Full refund • Design requests in progress: Pro-rated refund for the remaining period • All deliverables completed: No refund
Article 9 (Member Obligations)
① Members must not engage in the following: • Using another person's information or registering false information • Reproducing, distributing, or commercially using information obtained through the Service without the Company's prior consent • Infringing on the intellectual property rights of the Company or third parties • Interfering with the stable operation of the Service ② Members must faithfully provide necessary materials and information when making design requests.
Article 10 (Intellectual Property Rights)
① Copyright of design deliverables produced through the Service is transferred to the member upon final delivery and completion of payment for the relevant month. ② The Company may use deliverables for portfolio purposes, and will respect any restrictions requested by the member. ③ Rights and responsibilities for materials provided by the member (logos, images, text, etc.) remain with the member.
Article 11 (Service Changes and Suspension)
① The Company may change all or part of the Service for operational or technical reasons. ② The Service may be suspended due to force majeure such as natural disasters or system failures, in which case the Company will notify members before or after the event. ③ If suspension is prolonged, compensation or refunds for the remaining subscription period will be provided.
Article 12 (Disclaimer)
① The Company is not liable for service disruptions caused by circumstances attributable to the member. ② The Company is not liable for any loss of expected profits or damages arising from the member's selection or use of service materials.
Article 13 (Dispute Resolution)
① In the event of a dispute regarding these Terms, the Company and the member shall negotiate in good faith for an amicable resolution. ② If a resolution cannot be reached through negotiation, the competent court shall be the court having jurisdiction over the Company's location.
Supplementary Provisions
These Terms of Service are effective as of January 1, 2025.
